“A tese do voto médio de Toffoli não encontra eco nem no próprio STJ, que passaria a ser a instância para se aplicar a prisão, e vem perdendo força no Supremo, segundo ministros das duas Cortes ouvidos pelo GLOBO. Integrantes do STJ dizem que, se a regra for vencedora, o tribunal vai precisar se reorganizar para acomodar a nova realidade, com a adoção de uma estratégia para julgar com mais celeridade os recursos, dando prioridade para réus presos.”
O STJ, então, está preocupado em fazer Justiça. Os tribunais superiores deveriam desde sempre dar prioridade a réus presos. Todos, claro, não apenas os poderosos.
